Our liability shall in any event be limited to a maximum of the amount of the guarantee provided by the professional liability insurance of the Bar Association.

2. Services - fees and costs

 

AVvocato provides legal advice and assistance in case of disputes before the court, assistance in negotiations, including company meetings, the drafting of contracts, all this in application of the regulations of the Order of Flemish Bar and its deontology.

2.1.

Unless agreed otherwise, lawyers' fees are calculated on the basis of an hourly rate.

The hourly wages are communicated to the client during an initial consultation and are budgeted according to criteria such as complexity, urgency, etc.

2.2.

​

The acceptance of an order may be the subject of a prior request for payment in which the payment by the client is the confirmation of the order.

2.3.

​

The services provided are usually invoiced on a monthly basis. Respect of the payment deadline implies confirmation of the continuation of the order.

2.4.

 

In addition to the monthly billing, the firm may charge a commission for future fees and expenses, including court fees, which may remain reserved during the handling of the case.

 

2.5.

 

Office costs should preferably be calculated on a flat-rate basis, based on a percentage of the fees. Special costs can be seperately accounted for.

 

3. The client

 

3.1.

 

The client is responsible for providing all information relating to the case, if necessary confidentially covered by the lawyer's legal professional secrecy.

 

3.2.

 

The client provides the appropriate information regarding his or her address, telephone, fax and e-mail, which allows lawyers to correspond personally and confidentially.

Any changes in this respect must be notified to the office immediately and in writing.

 

3.3.

If payment is not made within the period mentioned on the invoice, interests of 8 % per year shall be due. Sending a notice of default is not required for this purpose. A fix compensation of 10 % of the total amount of the fee, with a minimum of 75 EUR will also be charged.

AVvocato will then have the right as well to suspend further services.

3.4.

​

The Client must be aware of strict procedural deadlines prescribed by the Law. Questions to the Client should therefore be answered as soon as possible.

4. Disputes

​

4.1. Ombudsman

​

For information in this respect, the client may contact the secretariat of the Antwerp Bar: Butterfly Palace, Bolivarplaats 20, Antwerp.

4.2. Belgian Law and Antwerp Court

​

Belgian law shall apply and the Courts of Antwerp shall have jurisdiction in this matter.
